Please read these Terms of Service carefully before engaging Hello Web Studios for web design services. By requesting a quote, signing a project agreement, or paying for services, you agree to be bound by these terms.
1. Services
Hello Web Studios provides web design, web development, and related digital services to small businesses. The specific scope of work for each project will be agreed upon in writing (via email or a separate project agreement) before work begins. Any changes to the agreed scope may result in additional fees and revised timelines.
2. Payment Terms
We offer both upfront payment and monthly subscription options. For upfront projects, a deposit (typically 50%) is due before work begins, with the remaining balance due upon project completion and prior to the site going live. For monthly plans, payment is due at the start of each billing cycle. We reserve the right to pause or suspend services in the event of non-payment.
3. Client Responsibilities
To complete your project on time, we require timely feedback, content (text, images, logos), and any necessary access credentials from you. Delays in providing required materials may result in delays to the project timeline. Hello Web Studios is not responsible for delays caused by the client’s failure to provide information or approvals in a timely manner.
4. Ownership and Intellectual Property
Upon receipt of full payment, you (the client) will own the final delivered website design and content created specifically for your project. Hello Web Studios retains the right to use the completed website in our portfolio and for promotional purposes unless you request otherwise in writing.
Third-party elements used in your website (such as WordPress, plugins, stock images, or fonts) remain subject to their respective licenses. Hello Web Studios is not responsible for any license violations resulting from client-provided content.
5. Revisions
Each project includes a reasonable number of revisions as agreed upon in your project scope. Significant changes to the design or functionality beyond the agreed scope may be subject to additional charges at our standard hourly rate.
6. Hosting and Maintenance
If you have a monthly plan that includes hosting and maintenance, Hello Web Studios will maintain your site and keep it updated during the term of your subscription. We will make reasonable efforts to ensure uptime and security but cannot guarantee 100% availability, as our services rely on third-party hosting providers.
7. Cancellation
For monthly subscriptions, either party may cancel with 30 days’ written notice. Upon cancellation, you will retain access to your website through the end of the paid billing period. Deposits for project-based work are non-refundable once work has commenced.
8. Limitation of Liability
Hello Web Studios is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use your website, including but not limited to loss of revenue, data loss, or business interruption. Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to Hello Web Studios in the three months preceding the claim.
9. Warranties
Hello Web Studios warrants that we will perform services in a professional and workmanlike manner. We do not guarantee specific business outcomes, search engine rankings, or website traffic as a result of our services.
10. Governing Law
These Terms of Service are governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved in the courts of Wisconsin.
11. Changes to These Terms
We may update these Terms of Service from time to time. We will notify existing clients of material changes. Continued use of our services after changes take effect constitutes acceptance of the revised terms.
